1.    Introduction 

La Dorada ABN 86 426 732 646 offers automated 24/7 spray tanning services that can be booked through the website or mobile application. These Terms and Conditions govern the use of our facilities, website, and mobile application. By using our services, you agree to these Terms. If you do not accept these Terms, please refrain from using our services.

 

2.    Changes to Terms 

We reserve the right to amend these Terms and Conditions at any time. Updates will be effective immediately upon notification via our website. Continued use of our services signifies acceptance of these changes.

 

3.    Registration to use the Services

  1. In order to access the Services, you must first register for an account and become a member through the Website.

  2. As part of the registration process, or as part of your continued use of the Services, you may be required to provide personal information about yourself (such as identification or contact details), including:

    • Email address

    • Preferred username

    • Mailing address

    • Telephone number

    • Password

  3. You warrant that any information you give to La Dorada in the course of completing the registration process will always be accurate, correct and up to date.

  4. Once you have completed the registration process, you will be a registered member of the website and agree to be bound by the Terms and Conditions.

  5. You may not use the Services if:

    • you are not of legal age to form a binding contract with La Dorada; or

    • you are a person barred from receiving the Services under the laws of Australia or other countries including the country in which you are resident or from which you use the Services.


You are responsible for maintaining the confidentiality of your account information and ensuring that all details provided are current and accurate.

 

4.    Payment 

Payments can be made via:  Credit Card, Debit Card, Direct Debit

  • All transactions are processed through Ezidebit. By providing payment information, you agree to the Payment Processor’s terms and conditions which are available on their website. We reserve the right to change the pricing of the services at any time.

  • When you provide us with your payment information, you authorise our use of and access to the payment instrument you have chosen to use. By providing us with your payment information, you authorise us to charge the amount due to this payment instrument.

  • You acknowledge and agree that where a request for the payment of the Services Fee is returned or denied, for whatever reason, by your financial institution or is unpaid by you for any other reason, then you are liable for any costs, including banking fees and charges, associated with the Services Fee.



If we believe your payment has violated any law or these Terms and Conditions, we reserve the right to cancel or reverse your transaction.

 

5.    Refund Policy 

Refunds are not provided except where we are unable to deliver services due to exceptional circumstances, at our sole discretion. Refunds will only cover the unused portion of any prepaid services.

 

6.    Membership and Use of Services 

Memberships are personal, non-transferable, and may not be shared. Each membership package is subject to these Terms. You are responsible for using our services as intended, following provided instructions, and adhering to our after-care recommendations.

 

7.    Cancellations and Rescheduling 

To cancel or reschedule an appointment, please notify us at least one hour prior. Failure to do so may result in a cancellation fee as outlined on our website.

 

8.    Termination and Suspension of Membership 

We may suspend or terminate your membership for violations of these Terms, misuse of services, or any illegal or unsafe behaviour within our facilities. We will notify you in writing of any suspension or termination.

 

9.    Compliance with Health & Safety Instructions

A condition of use of our Services and studio is that you agree to comply with the Health & Safety Instructions as varied from time to time and published on our website www.ladorada.com.au and mobile application.

 

10. Indemnity and Limitation of Liability 

  •  i. Subject to any non-excludable consumer guarantees and other consumer protection provisions set out in the Australian Consumer Law, the material displayed on this Website is provided without any guarantees, conditions or warranties as to its accuracy.

  • ii. You agree to indemnify, defend and hold us, our directors, officers, employees, consultants, agents, and affiliates, harmless from any and all third party claims, liability, damages or costs (including, but not limited to, legal fees) arising from your use of the Website, App and/or our Services or your breach of these Terms of Conditions.

  • iii. You understand and voluntarily accept the risks associated with the use of the Services and attendance at our studios and release us, our directors, officers, employees, consultants, agents, and affiliates, from all liability for any injury, including without limitation, personal, bodily, or mental injury, economic loss, or any damage to you or any other person, resulting from your use of our studios and Services.

  

11. Your Responsibilties

      i.         You agree to use the Services only for their intended purpose and in accordance with these Terms and all applicable laws.

     ii.         You are responsible for protecting the confidentiality of your password. Don't share it with anyone.

    iii.         You agree to notify us immediately of any unauthorised use of your password or any security breach.

   iv.         Your access to the Services is for your personal, non-commercial use only.

     v.         You may not use the Services for any illegal or unauthorised activity

   vi.         We reserve the right to remove any unauthorised content on third party platforms, including advertisements, and take legal action for misuse.

  vii.         You may only use our service if you have completed our "Spray Tan Consent" by agreeing to the Terms and Conditions and are deemed eligible from this. 

 viii.         When using/operating our machine you will use it for its intended use only.

   ix.         You will follow all instructions provided to you for before and after care.
